Agreement to our legal terms

These Terms and Conditions ("Terms") govern the use of this website and the booking and participation in Kendo training sessions provided by START KENDO ("we", "us", or "our").
By making a booking through our website, you acknowledge that you have read and agreed to these Terms.

1. Our Services

We provide Kendo training sessions suitable for beginners as well as participants with previous Kendo experience.
Sessions are currently available as individual bookings. A session may be attended by one or more participants, with a maximum of five (5) participants per session.
A single booking does not guarantee a private session. Participants may be joined by other customers who book the same time slot.
Single sessions are normally two (2) hours in duration.
We may offer additional services or subscription plans in the future. Any such services will be subject to their own applicable terms and conditions.

2. Booking and Group Size

Customers may book one or more places for the same session, subject to availability.
When separate customers book the same time slot, their bookings may be combined into the same session, up to a maximum of five participants.
If a new booking would cause a session to exceed the maximum capacity of five participants, we will contact the customer whose booking was received last and offer alternative available dates or times.
If none of the proposed alternatives are suitable, the customer will be entitled to a full refund for the affected booking.
While we make every effort to ensure that availability shown on the website is accurate and up to date, a selected time slot may occasionally become unavailable while a booking is being processed. In such cases, we will contact the customer as soon as possible and offer alternative available dates or times.

3. Booking Confirmation

A booking confirmation will be sent to the email address provided during the booking process.
Depending on the customer's email provider or settings, the confirmation email may be filtered into a spam, junk, or other automatically filtered folder.
Customers are responsible for providing a valid and accurate email address and should check their spam or junk folders if they do not receive their confirmation.

4. Locations

Kendo sessions are held at various dojo locations.
The applicable location is indicated on the website and may also be provided or confirmed after booking.
Customers are responsible for checking the location and allowing sufficient time to arrive before the scheduled session at the meeting point.

5. Prices and Payment

Prices are displayed and charged in Japanese Yen (JPY) on the relevant service pages.

Payment is made at the time of booking through the payment methods available on the website.

Payments are processed by third-party payment providers, including Stripe.

Please note that your bank or card issuer may apply additional fees, including foreign exchange or currency conversion fees, depending on your bank, card, or account currency. Any such fees are charged by your bank or card issuer and are the customer's responsibility. These fees are not included in the prices displayed on the website.

6. Cancellation, Rescheduling and Refunds

Cancellations or rescheduling requests must be made by email to:

at least 24 hours before the scheduled session.

- 24 hours or more before the session: Full refund.
- Less than 24 hours before the session: No refund.
- No-show: No refund.

In cases of illness or genuine emergencies, please contact us as soon as possible. We may offer a refund or rescheduling at our discretion.
If we cancel a session, customers will receive a full refund or may reschedule for another available date.
Eligible refunds will be processed within 10 business days of receiving the cancellation request and issued to the original payment method. The time required for the refund to appear may vary depending on the payment provider, card issuer, or bank.

7. Late arrival

Participants should arrive sufficiently early to prepare for the session.If you expect to be late, please contact us at least 15 minutes before the scheduled start time.
We will make reasonable efforts to accommodate late arrivals where possible. However, sessions must end at the scheduled time.
Late arrival does not automatically entitle the participant to an extension, rescheduling, or refund.

8. Participant Eligibility

Participants must be between 10 and 70 years of age.
Participants under 18 must be accompanied by a parent or legal guardian who remains present at the dojo throughout the session. The parent or guardian may observe the session without participating.
Our sessions are designed to accommodate beginners, and participants of other experience levels are also welcome.

9. Health and Physical Requirements

Kendo is a physical activity involving movement, exercise, physical contact, and the use of protective equipment.
Participants must be physically fit and able to safely participate in the session.
For safety reasons, pregnant individuals and individuals with serious knee problems or injuries are not permitted to participate in Kendo training sessions.
If you have any medical condition, injury, or physical limitation that may affect your ability to participate safely, you should consult a qualified medical professional before participating.
Participants should inform the instructor before the session of any relevant physical limitation or injury that may affect their participation.
We do not require customers to provide detailed medical information as part of the booking process.

10. Clothing and Equipment

Kendo equipment is provided as part of the service and include, depending on the session:

- Hakama
- Keikogi
- Shinai
- Men
- Do
- Tare
- Other equipment required for the session

Participants should wear comfortable clothing suitable for physical activity underneath the provided Kendo clothing.
The Kendo clothing is worn over the participant's own clothing. Lightweight clothing is therefore recommended in warm weather to avoid excessive heat.
Participants are expected to use the equipment responsibly and follow the instructor's instructions regarding its use.

11. Safety and Participant Conduct

Participants must follow the instructions of the instructor and any assistants throughout the session. Participants are expected to:

- behave respectfully towards the instructor, assistants, other participants, and staff;
- use the equipment properly;
- follow safety instructions;
- inform the instructor if they feel unable to continue safely;
- comply with the rules of the dojo.

Participants must not attend or participate while under the influence of alcohol or illegal drugs.We reserve the right to stop a participant's participation if their behaviour creates a safety risk or seriously disrupts the session.

12. Equipment and Property

By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. Please be advised the Services are hosted in France. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in France, then through your continued use of the Services, you are transferring your data to France, and you expressly consent to have your data transferred to and processed in France.

13. Weather, Transportation and Exceptional Circumstances

Sessions are normally held indoors and will generally proceed as scheduled.
In exceptional circumstances, including severe weather conditions or major disruption to public transportation, we may postpone a session where attending the scheduled session is not reasonably possible or safe.
Where a session is postponed, we will offer an alternative date or time.
If no suitable alternative can be arranged, the customer will receive a full refund.
In exceptional circumstances beyond our reasonable control, such as a major natural disaster, the session may need to be cancelled or postponed.

14. Photography and Video

From time to time, photographs or videos may be taken during Kendo sessions for promotional and communication purposes, including publication on our website and social media channels.
We will request separate written consent before using an identifiable participant's photograph or video for such purposes.
Consent is voluntary and is not a condition of booking or participating in a session.
For participants under 18, written consent must be provided by their parent or legal guardian.
If you do not provide consent, reasonable efforts will be made to avoid using identifiable images or videos of you for promotional purposes.

15. Intellectual Property

All content available on this website, including text, photographs, videos, graphics, logos, illustrations, and other materials, is owned by or used with permission by START KENDO.
Unless otherwise permitted by law or with our prior written permission, website content may not be copied, reproduced, modified, distributed, published, or used for commercial purposes.

16. Website Use

You agree to use this website lawfully and responsibly.
You must not:

- provide false or misleading information when making a booking;
- attempt to interfere with or disrupt the website or booking system;
- attempt to gain unauthorized access to the website or its systems;
- use the website for fraudulent or unlawful purposes.

17. No Guarantee of Results

Kendo training is an educational, cultural and physical training activity.
Participation does not guarantee any particular level of skill, progress, performance, achievement, or other specific result.
Individual results may vary depending on experience, participation, physical condition, practice, and other factors.

18. Liability

We take reasonable steps to provide our services safely and professionally.
However, participation in Kendo involves inherent physical risks, and participants are responsible for following safety instructions and using the equipment appropriately.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, we are not responsible for losses or damage resulting from circumstances beyond our reasonable control or from a participant's failure to follow safety instructions or these Terms.

19. Third-Party Services

Our website relies on third-party services to provide certain functions, including booking, hosting, email delivery, and payment processing.
These services may be subject to the respective terms and policies of the relevant third-party providers.
Personal information is handled in accordance with our Privacy Policy.

20. Governing Law and Consumer Rights

These Terms are governed by the laws applicable to the operation of our business in Japan.
Nothing in these Terms is intended to exclude or restrict any mandatory consumer rights or protections that apply to you under the laws of your country or region.
Where applicable, consumers may have additional rights under the mandatory laws of their place of residence.

We may update these Terms from time to time to reflect changes to our services, website, business practices, or applicable legal requirements.
